Why do you need a POA?

A Durable Power of Attorney is a legal document that grants authority to an individual, known as an “attorney in fact,” to act on behalf of the person creating the document, even in the event of their declared incompetence.

This document remains effective even if the person granting the power becomes disabled or lacks sufficient mental competence. By having a Durable Power of Attorney, one can proactively designate the person who will manage their affairs in case of incompetency. In its absence, the matter would require presentation to a court, leading to the appointment of a conservator to handle the individual’s affairs.
